Welcome to GenieSign. These Terms of Use govern your access to and use of our website, platform, and services. By using our platform, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the service.

1. About GenieSign

GenieSign is a digital signature platform operated by GenieSign Sdn. Bhd. (“we”, “us”, “our”), incorporated in Malaysia with its registered address at:

GenieSign enables users to create legally binding digital signatures and apply them to documents through WhatsApp and a web portal.

These Terms form a legally binding agreement between you and GenieSign Sdn. Bhd. By using the service you confirm that you have read, understood, and agree to be bound by them.

2. Eligibility

To use GenieSign you must:

  • Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher
  • Have the legal capacity to enter into binding contracts under the laws of your jurisdiction
  • Provide accurate and truthful personal information during onboarding, including your full name, email address, mobile phone number, and government-issued identity document number
  • Not be prohibited from using digital or electronic signature services under any applicable law

By accepting these Terms you confirm that all of the above conditions are met.

If you are using GenieSign on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms.

3. Legal Framework for Electronic Signatures

GenieSign provides electronic signature services. The legal validity of an electronic signature varies by jurisdiction.

GenieSign produces electronic signatures. We do not currently act as a licensed Certification Authority and do not issue Qualified Electronic Signatures (QES) under eIDAS or equivalent advanced signatures under other frameworks. Users signing documents that require a higher assurance level should use an appropriate certified provider.

4. The Service

GenieSign provides the following services:

  • Creation of a digital signature by processing a photograph of your handwritten signature
  • Uploading and AI-assisted analysis of documents to identify signature fields
  • Application of your digital signature to uploaded documents
  • Generation of a signed document with a timestamp, basic identity information, and an audit trail
  • Delivery of the signed document via WhatsApp and, where applicable, storage for a defined period
  • Multi-party signing: enabling you to send a document to one or more other parties for their signature

The service is delivered primarily through WhatsApp and our web portal at app.geniesign.io. We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable prior notice.

5. Document Eligibility and Excluded Document Types

GenieSign is a general-purpose electronic signature service suitable for most commercial and personal documents. However, certain categories of documents cannot lawfully be signed electronically in many jurisdictions and are therefore excluded from the scope of GenieSign’s service. These commonly include, but are not limited to:

  • Wills, codicils, and testamentary instruments
  • Negotiable instruments such as promissory notes and bills of exchange
  • Documents requiring notarisation, a Commissioner for Oaths attestation, or a Notary Public seal
  • Instruments dealing with land, real property, or conveyancing
  • Court documents and sworn affidavits requiring a physical signature before an authorised officer
  • Powers of attorney in certain jurisdictions
  • Any document that applicable law in your jurisdiction expressly requires a wet-ink (physical) signature

  • Collection and validation of your full name, email address, and mobile phone number
  • Email one-time password (OTP) verification to confirm your email address
  • Collection of your government-issued identity document number

This verification constitutes “basic identity verification” for the purpose of generating an audit trail. It does not constitute biometric KYC, advanced identity proofing, or a certified identity assertion. The identity information collected is incorporated into the signature certificate attached to each signed document to evidence who signed and when.

You confirm that all identity information you provide is accurate, current, and your own. Providing false identity information in connection with the signing of a document may constitute fraud or a criminal offence in your jurisdiction.

7. Digital Signature and Legal Validity

By applying your signature through GenieSign, you:


  • Confirm that you have read and understood the document you are signing
  • Confirm that you intend to be legally bound by the content of the document
  • Consent to the use of an electronic signature in place of a physical signature for the purposes of that document
  • Acknowledge that your signature may be relied upon by other parties to the document

GenieSign is not a party to any document you sign using the service. We are not responsible for the content, accuracy, legality, or enforceability of any document signed through GenieSign. Any dispute arising from a document signed via GenieSign is solely between you and the other parties to that document.

8. AI Processing of Your Documents and Signature

GenieSign uses artificial intelligence to:


  • Analyse documents you upload to detect signature fields and determine appropriate signature placement
  • Generate a plain-language summary of your document type for display purposes
  • Process your handwritten signature image to generate a digital replica for use in signing
  • Assess documents for compliance with plan-based limits (such as page count and number of signature fields)

By uploading a document or signature image, you explicitly consent to this AI-based processing. We do not use your documents, signature image, or personal data to train AI models. Documents are processed solely to deliver the signing service and are not retained by our AI service providers beyond the immediate processing request.

The AI signature placement is automated. While we take reasonable care to ensure accuracy, you are responsible for reviewing the signed document upon receipt. If a signature has been placed incorrectly, please contact our support team.

9. Signature Replication and Storage

You consent to GenieSign processing the image of your handwritten signature to generate a digital replica for use within your account. By submitting your signature image, you confirm that:

  • The signature is your own
  • You have the right to use it as your legal signature
  • You authorise GenieSign to store and apply it to documents you submit through the service

Your digital signature is stored securely and used exclusively within your GenieSign account. It will not be shared with or made accessible to other users. You may request deletion of your stored signature at any time by contacting our support team. Deletion of your signature means we will no longer be able to sign documents on your behalf.

Prices are shown in local currencies and are exclusive of any applicable taxes. Taxes will be applied at checkout where required by law in your jurisdiction. We reserve the right to change pricing with at least 30 days’ prior notice to existing subscribers. Price changes will not affect your current billing period.


  • You may cancel your subscription at any time by sending “Cancel” in your WhatsApp conversation with the GenieSign bot, or by contacting our support team.
  • Cancellation takes effect at the end of your current billing period. You retain access to Personal Plan features until that date.
  • We do not issue refunds for partially used billing periods unless required by applicable law in your jurisdiction (see Section 15 for EU/UK consumer rights).

11. Multi-Party Signing

GenieSign supports sending a document to other parties for their signature. When using this feature:


  • You confirm that you have the right to request a signature from each person you invite
  • You confirm that you have a legitimate purpose for sending the document
  • Each invited signer must independently consent to the GenieSign Terms and Privacy Policy before signing
  • You are responsible for ensuring that the document is legally eligible for electronic execution and that all parties have capacity to sign
  • Documents expire and become invalid for signing if not all required signatures are collected within 7 days of the signing request being sent
  • A maximum of 5 total signers (including yourself) are permitted per document

12. Acceptable Use

You agree to use GenieSign only for lawful purposes and in accordance with these Terms. You must not:


  • Sign documents on behalf of another person without their knowledge and explicit consent
  • Provide false, misleading, or inaccurate identity information
  • Use another person’s signature or identity information
  • Upload documents containing illegal, defamatory, fraudulent, or harmful content
  • Use GenieSign to facilitate fraud, money laundering, or any other criminal activity
  • Attempt to reverse-engineer, decompile, or exploit any part of the GenieSign platform or its AI systems
  • Use automated tools, bots, or scripts to interact with GenieSign other than through our supported interfaces
  • Resell, sublicense, or commercially exploit GenieSign without our written permission

We reserve the right to suspend or terminate your account immediately and without notice if we have reasonable grounds to believe you have breached any of the above.

13. Data Protection and Privacy

Your use of GenieSign involves the collection and processing of personal data. Our Privacy Policy, available at [geniesign.com/privacy], explains in full how we collect, use, store, and protect your personal data, including your rights under applicable data protection laws.


By using GenieSign you acknowledge that you have read our Privacy Policy and consent to the collection and processing of your personal data as described therein. Our Privacy Policy is incorporated into these Terms by reference.

14. Limitation of Liability

To the maximum extent permitted by applicable law, GenieSign provides the service on an “as is” and “as available” basis without warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, GenieSign’s total liability to you for any claim arising from or related to your use of the service shall not exceed the total fees paid by you to GenieSign in the 12 months preceding the event giving rise to the claim, or USD 100, whichever is greater.

In no event shall GenieSign be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising from your use of or inability to use the service.

GenieSign is not liable for:

  • The legal validity or enforceability of any document signed through the service
  • Any dispute between you and another party to a document you signed via GenieSign
  • Any loss arising from your failure to download or retain signed documents within the applicable storage period
  • Any interruption, delay, or failure of the WhatsApp platform or any third-party service provider

15. Intellectual Property

GenieSign and all content, technology, software, and materials on the platform are owned by or licensed to GenieSign Sdn. Bhd. and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the GenieSign platform without our prior written consent

You retain full ownership of any documents you upload to GenieSign. By uploading a document, you grant GenieSign a limited, non-exclusive, royalty-free licence to process that document solely for the purpose of delivering the signing service. This licence terminates when the document is deleted from our systems.

16. Changes to the Service and These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via WhatsApp message or your registered email address at least 14 days before the changes take effect. The updated ‘Last updated’ date at the top of this document will reflect the most recent revision.

Continued use of GenieSign after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the service before the effective date.

We may also modify, suspend, or discontinue any feature of the service at any time. Where feasible, we will give reasonable advance notice of significant changes to core features.

17. Termination

Either party may terminate the use of GenieSign at any time:

  • You may stop using GenieSign and request deletion of your account and data by contacting our support team at [email protected]
  • We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or if required by law.

On termination: any outstanding signed documents stored within the retention period will be made available for download for 7 days post-termination, after which they will be deleted. Subscription fees already paid will not be refunded for the remaining billing period, except where required by applicable law (see Section 19 for jurisdiction-specific rights).

18. Dispute Resolution

Disputes should first be raised informally with our support team. If unresolved, disputes may proceed to arbitration in Kuala Lumpur, Malaysia.

18.1 Informal Resolution

If you have a dispute with us, please contact us first at [email protected]. We will make reasonable efforts to resolve your concern informally within 30 days.

18.2 Arbitration

If a dispute cannot be resolved informally, you and GenieSign agree to resolve it through binding arbitration under the rules of relevant Arbitration Body rather than through court proceedings, except where this is prohibited by mandatory law in your jurisdiction. The seat of arbitration shall be Kuala Lumpur, Malaysia. The language of arbitration shall be English.

18.3 Consumer Exceptions

Notwithstanding the arbitration clause above, if you are a consumer located in the European Union, United Kingdom, or any other jurisdiction whose mandatory consumer protection laws prohibit mandatory arbitration clauses, you retain the right to bring a claim before the courts of your place of residence. EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

18.4 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, collective, or representative action. This waiver does not apply where prohibited by mandatory law.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

However, nothing in this clause overrides any mandatory consumer protection laws applicable in your jurisdiction. If you are a consumer in the EU or UK, you also have the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of that country.

20. Language

These Terms are published in English as the authoritative version. Where we operate in markets that require or recommend a local-language version (for example, Bahasa Malaysia for the Malaysian market, Portuguese for Brazil, or French for French-speaking markets), translated versions will be made available on our website. In the event of any inconsistency between the English version and a translated version, the English version shall prevail unless mandatory local law requires otherwise..

21. General Provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GenieSign in relation to the service and supersede all prior agreements and understandings.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Failure by GenieSign to enforce any provision of these Terms will not constitute a waiver of our right to enforce that provision in the future.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor entity in connection with a merger, acquisition, or sale of our business.

22. Jurisdiction-Specific Supplements

The following additional terms apply to users in specific jurisdictions. These supplements apply in addition to the rest of these Terms and will prevail over any conflicting provision where mandatory local law requires.


22.1 European Union and European Economic Area

  • Right of withdrawal: If you are a consumer and you purchased a Personal Plan subscription, you have a right to withdraw from the contract within 14 days of purchase without giving any reason, provided you have not yet used the service during that period. If you have used the service (e.g. signed a document) during the 14-day period, you acknowledge that the right of withdrawal is lost in respect of the service already provided, consistent with Article 16(a) of the Consumer Rights Directive.
  • Service quality: The service will be provided with reasonable skill and care in accordance with the EU Consumer Rights Directive and applicable national implementing legislation.
  • Contract information: A summary of these Terms and key contract information is available at [geniesign.com/terms-summary] in your local language where required.
  • Supervisory authority: Disputes relating to data protection matters may be referred to your local data protection supervisory authority. See our Privacy Policy for contact details.

22.2 United Kingdom

If you are located in the United Kingdom:

  • Your statutory rights as a consumer under the Consumer Rights Act 2015 are not affected by these Terms.
  • The service will be performed with reasonable care and skill in accordance with the Consumer Rights Act 2015.
  • If the service is not performed as described, you may be entitled to a repeat performance or a price reduction.
  • The arbitration clause in Section 19.2 does not apply to consumer disputes in the UK. You retain the right to bring proceedings in the English, Scottish, or Northern Irish courts.

22.3 Australia

If you are located in Australia, the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) applies. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

22.4 Malaysia

If you are located in Malaysia, the service operates in accordance with the Electronic Commerce Act 2006 and applicable Malaysian law. Signatures produced by GenieSign are electronic signatures under the ECA and are not digital signatures issued under a licensed Certification Authority under the Digital Signature Act 1997. Your rights under the Malaysian Consumer Protection Act 1999 are not excluded by these Terms.

22.5 Other Jurisdictions

If you are located in a jurisdiction not listed above, local mandatory consumer protection, electronic signature, or data protection laws may provide you with rights and protections that supplement or override these Terms.
